Bookings

A booking can be considered as confirmed once full payment and completed booking forms have been received by MJ Outdoor Adventures and we have issued you with a booking confirmation. This booking confirmation forms the contract between MJ Outdoor Adventures and the client(s) and comes into effect from the date the confirmation is issued.

Prior to the start of your activity, you will be required to complete and sign a booking registration form providing details of emergency contacts and any medical conditions the leader needs to be aware of together with the declarations included at the end of this document.

Alterations

MJ Outdoor Adventures will always do their best to accommodate reasonable requests to alter your booking such as a change to the names of clients included in your booking or, in the case of private guiding, a change to the itinerary.  If there are associated costs relating to such a change we reserve the right to discuss these costs with you and make an additional charge for them if the alteration is agreed

Day Event Cancellations

In the event of a booking being cancelled by a client, MJ Outdoor Adventures will refund as follows:

In exceptional circumstances, MJ Outdoor Adventures may need to cancel your booking. If MJ Outdoor Adventures cancel your booking you will have a choice of receiving a full refund or changing your booking to an alternative date or activity of equal value. If you prefer to change to an activity of a higher value you will be required to pay the difference. We will not be liable for any additional costs or expenses incurred as a result of such a cancellation. For larger events or trips we strongly encourage participants to have their own travel insurance.

Mixed group walks operate with a minimum number of 5 participants. If attendances falls below this we may contact you to offer you the choice of swapping to an alternative date or activity or to receive a full refund.

Force Majeure:
MJ Outdoor Adventures will not be liable for failure to perform any of its obligations due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather, acts of war, strikes, pandemics, or government-imposed restrictions. A credit note at this time will be given.

Bad Weather & Other External Factors

Activities will generally take place regardless of the weather on the day unless the leader considers that conditions could compromise the safety of the group.  No refunds will be made if a client decides to cancel as a result of weather conditions.

Other factors such as, but not limited to, landslides, flooding, footpath and rights of way restrictions can also impact the ability to undertake a planned itinerary. As a result, changes may need to be made at the leader’s discretion. We reserve the right to make changes to the itinerary on the day or to cancel the booking where appropriate or for safety reasons.

Trips and Holidays Cancellations

The following terms apply to all multi-day trips, holidays and overseas adventures organised by MJ Outdoor Adventures and supersede the standard cancellation policy where applicable.

Booking Deposit

A non-refundable deposit is required to secure your place on any multi-day trip or holiday. The amount of the deposit will be stated on the individual trip booking page.

The deposit is non-refundable under all circumstances, including if you choose to cancel your booking, unless:

If any charges are incurred (including, but not limited to, administration fees, supplier amendment fees, airline charges or accommodation name change fees), these must be paid by the original booking holder before the transfer can be completed.

Final Payment

The balance of your trip must be paid by the final payment date stated on your booking confirmation.

MJ Outdoor Adventures will send multiple payment reminders before the final payment deadline. If payment is not received by the due date and no contact has been made to discuss your booking, we will assume you no longer wish to attend the trip.

Where applicable, these costs will be invoiced to you and payment will be due within the timeframe stated on the invoice.

Cancellation by You

If you cancel your booking after paying the deposit, your deposit will remain non-refundable.

Where a booking is cancelled after the deposit has been paid but before the final balance is due, you will remain liable for 50% of the outstanding balance. This is due to accommodation, supplier, vendor and other third-party costs that may be committed or incurred by MJ Outdoor Adventures at the time of your booking and will be due within 2 weeks of you cancelling.

If you are able to find a suitable replacement participant to take your place, your booking may be transferred to them, subject to approval by MJ Outdoor Adventures. In this situation, the cancellation charges may be avoided, provided the replacement participant takes over the booking and all associated payments and requirements are met.

If you cancel after paying additional instalments or the full balance, any refund will depend on the costs already incurred and whether a suitable replacement participant can be found to take your place. Any non-recoverable costs, including accommodation, transport, supplier and other third-party expenses, will be deducted from any refund due.

If you are unable to attend your trip after making payment, you should contact your travel insurance provider as soon as possible to begin the claims process. MJ Outdoor Adventures will provide reasonable assistance by supplying booking confirmations, invoices and cancellation documentation required by your insurer.

MJ Outdoor Adventures cannot guarantee the outcome of any insurance claim and accepts no responsibility for decisions made by your insurance provider.

Transfer of Booking

If you wish to transfer your place to another person, this may be permitted at the sole discretion of MJ Outdoor Adventures, subject to supplier approval and any booking conditions.

The replacement participant must meet all trip requirements and accept the booking terms and conditions.

Any costs incurred as a result of transferring the booking, including supplier amendment or administration fees, will be payable by the original booking holder unless otherwise agreed.

Non-Payment of Invoices

Failure to pay any outstanding invoices issued under these terms may result in recovery action. MJ Outdoor Adventures reserves the right to recover any reasonable costs incurred in pursuing unpaid balances, including administrative costs and any applicable legal or debt recovery fees where permitted by law.

Supplier Terms

Many elements of our trips are provided by third-party suppliers. Bookings are also subject to the terms and conditions of those suppliers, which may include their own cancellation, amendment and refund policies. Where supplier terms are more restrictive than those of MJ Outdoor Adventures, those terms may apply.

Cancellation by MJ Outdoor Adventures

If MJ Outdoor Adventures is required to cancel a trip, you will be offered either:

MJ Outdoor Adventures will not be liable for any additional expenses incurred by participants, including but not limited to flights, accommodation booked independently, visas, equipment purchases or loss of earnings. This is another reason why comprehensive travel insurance is strongly recommended.

Accommodation Disclaimer

We aim to provide the accommodation outlined in the itinerary above. However, due to circumstances beyond our control, including availability, local events, weather, and the changing nature of logistics along the West Highland Way, it may occasionally be necessary to alter the planned accommodation or the night on which we camp or stay in pods. Should this happen, we will always endeavour to provide accommodation of an equal or higher standard to that advertised.

Route Changes and Safety

Whilst we always aim to follow the advertised itinerary and routes, outdoor adventures can be affected by circumstances beyond our control. This may include, but is not limited to, weather conditions, trail closures, safety concerns, local events, transport disruption or other unforeseen circumstances.

For the safety and enjoyment of the group, it may occasionally be necessary to adjust, alter or change an advertised route either prior to the trip or on the day itself. Any decision to make changes to the route will be at the discretion of the walk leader, with the safety and wellbeing of all participants being our highest priority.

Where a route change is necessary, we will always endeavour to provide an alternative experience that is equally enjoyable, scenic and memorable. Sometimes the unexpected route can lead to an adventure just as wonderful as the one originally planned!

Medical Fitness

It is the responsibility of each participant to ensure they are medically fit and capable of taking part in the activities included within the trip.

Any pre-existing medical conditions, injuries or disabilities that may affect your ability to participate must be disclosed to MJ Outdoor Adventures at the time of booking or as soon as reasonably possible if your circumstances change.

MJ Outdoor Adventures reserves the right to refuse participation, either before or during the trip, if we believe a participant's health or fitness may pose a risk to themselves or others.

Cancellation due to a pre-existing or undisclosed medical condition remains subject to the cancellation policy and does not entitle the participant to a refund outside of those terms. Participants should seek reimbursement through their travel insurance where appropriate.

Passports, Visas & Entry Requirements

It is the responsibility of each participant to ensure they have a valid passport, any required visas, vaccinations and any other documentation necessary to enter the destination country or countries visited during the trip.

MJ Outdoor Adventures accepts no responsibility for participants being refused entry, denied boarding, or otherwise unable to travel due to incorrect, expired or missing documentation.

No refunds will be given where a participant is unable to travel because they have failed to obtain the required travel documents or meet entry requirements.

Force Majeure

MJ Outdoor Adventures shall not be liable for any failure to perform its obligations where such failure is due to circumstances beyond our reasonable control. These may include, but are not limited to, extreme weather, flooding, wildfires, natural disasters, pandemics, epidemics, government restrictions or travel advice, war, terrorism, civil unrest, industrial action, transport disruption, supplier insolvency, or any other unforeseen event beyond our control.

Where possible, MJ Outdoor Adventures will make reasonable efforts to rearrange, postpone or offer an alternative itinerary. However, where costs have already been incurred or suppliers do not provide refunds, MJ Outdoor Adventures reserves the right to deduct any unrecoverable costs from any refund due.

Participants are strongly advised to ensure their travel insurance policy provides suitable cover for cancellation and disruption caused by such events.

Travel Insurance

Comprehensive travel insurance is a condition of booking for all multi-day trips and holidays.

Participants should purchase suitable travel insurance at the time of booking, or immediately after paying their deposit, to maximise cancellation cover. Many insurance providers will not cover events that occur before a policy has been purchased.

Your policy should include, as a minimum, cover for cancellation, medical expenses, personal injury, repatriation (where applicable), personal belongings, travel delays and disruption, and any activities included within your itinerary.

If you are unable to attend your trip after booking, you should contact your insurer as soon as possible to begin the claims process. MJ Outdoor Adventures will provide any booking confirmations, invoices or cancellation documentation reasonably required in support of your claim.

MJ Outdoor Adventures accepts no responsibility for the outcome of any insurance claim or for losses that would otherwise have been covered had suitable travel insurance been purchased.

Leader Authority & Client Behaviour

When taking part in an activity you must abide by the authority of the leader. If you commit any illegal act or in the reasonable opinion of the leader your behaviour is likely to be disruptive, threatening, abusive, a danger to yourself or causing or likely to cause danger, distress, damage to property or annoyance to others or the leader, or if you are under the influence of drugs or alcohol then we may terminate your participation in the activity without any liability on our part.

This includes clients who fail to advise us of medical conditions or disabilities or have an insufficient level of fitness which prevents their participation in the activity or adversely impacts the ability of other clients to participate in the activity as planned. This also includes clients who, in the opinion of the leader, are not appropriately equipped or clothed to safely participate in the activity.

MJ Outdoor Adventures operates a safe environment for all and we will not tolerate any harmful or abusive language or behaviour to other members of the group or general public.

MJ Outdoor Adventures reserves the right to ask any attendee or member to leave the group,

Parental Responsibility

Children under the age of 18 are only accepted by prior agreement on our activities. Any people under the age of 18 must be accompanied by their parents or legal guardians who agree to take full responsibility for their actions and safety and supervision of them at all times. This means people under 18 being within sight and sound of their parent or legal guardian and under their control at all times. We advise parents or legal guardians to remember that our members choose to attend events to enjoy the calm that nature can bring, and as such request that any under 18's are considerate of the group, respectful of the natural environment and wildlife, and do not engage in disruptive behaviour such as shouting, running ahead, or disturbing others.

For any child under 18 the information provided on our booking forms and the declarations below must be provided and signed for by the child’s parent or legal guardian. In providing and signing for this information you are confirming that the information is correct, that you will ensure that your child understands, as far as reasonably practicable, and is aware of the information provided, as well as the description and risks of the activity. You also confirm that your child has the relevant fitness and/or experience to participate in the activity and that you accept the risks for your child and give consent for them to take part.

Insurance, Risk and Liability

MJ Outdoor Adventures will take all reasonable measures to ensure your safety.

Please note however that outdoor activities including walking involve risk and have a danger of personal injury. Anyone taking part shall be aware of, and accept these risks, and agree to be responsible for their own actions and involvement and to raise any concerns or questions with the leader.

MJ Outdoor Adventures has full public and professional liability insurance, and we advise you to take out your own personal accident and liability insurance and appropriate cancellation insurance if you wish for events.

Our website, social media, emails and printed materials are to our best knowledge accurate and produced in good faith.  Clients must have a good written and spoken understanding of English so as to understand the information and risks of their activity and information or guidance provided by the leader on the day. MJ Outdoor Adventures can't take responsibility for any misunderstandings resulting from a client not reading or understanding this information.  MJ Outdoor Adventures can't accept responsibility for any loss or damage to your personal effects, property or vehicles during an activity.

Dogs

MJ Outdoor Adventures welcomes well-behaved dogs on most guided walks but is not always able to accept dogs, other than registered assistance dogs on tour events.  Dogs will be required to be on lead to protect wildlife and provide a safe environment for all walkers.

Health and Fitness

Bookings are accepted on the understanding that you and those you are booking on behalf of are medically and physically fit for the activity to be undertaken and that you and those you are booking on behalf of have obtained medical advice about the suitability to undertake the activity where appropriate. 

We ask clients to inform the activity leader if they suffer from any allergies, medical conditions, disabilities or injuries. If a client’s health and fitness situation changes after making the booking they should make us aware of such changes.

Medical Consent:
In the event of an emergency, the client consents to medical treatment being administered to them by appropriate medical professionals and understand that any costs incurred for such treatment will be their responsibility.

Allergies

If your booking includes food, please ensure that any food allergies and/or dietary requirements are clearly highlighted to MJ Outdoor Adventures at the time of booking so these details can be passed on to the business providing the food so they can see if they are able to adapt a dish to accommodate allergies or intolerances.  These requirements must also be highlighted by the client to the activity leader at the start of the activity and to the business providing the food on arrival at their premises.

Complaints

MJ Outdoor Adventures takes pride in the service it provides to our clients.  However, if you are unhappy, any complaint should first be made to your leader, as soon as possible, and ideally at the time.  Your leader will endeavour to find a solution that is acceptable to you but must also consider the group as a whole.  If for some reason the problem is not resolved to your satisfaction then you should put it in writing and send to our contact address or email us within 4 weeks of the end of your activity. All complaints will be fully investigated and we will keep you informed.

Declarations

Participation Statement

I and those I am booking on behalf of understand that outdoor activities including walking involve risk and have a danger of personal injury or death. Anyone taking part shall be aware of, and accept these risks, and agree to be responsible for their own actions and involvement and to raise any concerns or questions with the leader.

I and those I am booking on behalf of will participate in a responsible manner, conscious both of our own safety and of the impact of our conduct on the safety of others, and hold in mind our individual duty of care to all in our company.

Equipment & Clothing

I and those I am booking on behalf of have read the recommended equipment and clothing for the trip and confirm that I/we will come appropriately equipped and clothed for the weather on the day including appropriate footwear with good grip.

Medical disclaimer

I confirm that I and those I am booking on behalf of are medically and physically fit for the activity to be undertaken and that you and those you are booking on behalf of have obtained medical advice about the suitability to undertake the activity where appropriate. I have completed a PAR-Q form to enable the leader to deal with my medical issues if required.

I and those I am booking on behalf of understand the importance of notifying the walk leader of any medical conditions, disabilities, injuries, allergies or medications that will be carried that they should be aware of. This is in order that they can deal more effectively with any emergencies.

Photographs

Photos of our clients may be used in MJ Outdoor Adventures publicity, on our website or on our Social Media. Please make the event leader aware at the start of the event if you or any member of your group are not happy for this to happen.
